民间艺术品交易风波70万元假画案画家证实仅值几百元
近日,王某花70万元从张某处购得一幅署名史国良的画作《金秋》,后经史国良本人鉴定为仿制品。王某多次与卖主张某协商退款未果,故诉至法院,要求返还购画款并承担相应利息。原告王某诉称,他在任某介绍下认识了张某,并于2014年7月3日在北京购买了这幅画。在购买前,他详细询问了画的来源,但张 Certain assured him that the painting came directly from the artist, "absolutely reliable and genuine." When they exchanged the painting, Wang again emphasized that he wanted a genuine work of art. Zhang signed his name on the back of the painting to take responsibility for its authenticity.
After purchasing the painting, Wang showed it to a friend who took pictures of it and sent them to History for authentication. He received a response saying "fake." However, Wang was unable to reach an agreement with Zhang about returning the painting. In February 2021, Wang found History and asked him to authenticate the painting again. After examining it carefully, History wrote in his opinion: "This fake is a forgery of my own work with the same name."
Plaintiff Wang believes that defendant Zhang sold him a fake painting nearly three years ago and has been stalling and delaying ever since. Therefore, he sued in court, requesting that defendant return his purchase price of 70 million yuan plus interest totaling 11.86 million yuan for a total of 81.86 million yuan.
Defendant's lawyer argued that while plaintiff did indeed buy this called Gold Autumn calligraphy from defendant Zhang at will before knowing what he was getting into; however many people have their own opinions about art as well as those who don't like any form or style even if one person might think something looks good but another may not agree so there can be different opinions over things like this because everyone has their own taste when it comes down too personal preferences which means we cannot all see eye-to-eye on every single thing especially when talking about artworks such as paintings or sculptures where each piece tells its story differently depending on how you look at them through your eyes alone without any outside influence from others' viewpoints just by looking closely enough so I guess you could say these works are subjective rather than objective?
