70万元假画案艺术市场网站揭露物品真伪画家作证仅值三五百元
近日,李某花70万元从张某处购得一幅署名史国良的画作《金秋》,后经史国良本人鉴定为仿制品。李某多次与卖主张某协商退款未果,故诉至法院,要求返还购画款并承担相应利息。原告李某诉称,他在任某介绍下认识了张某,并于2014年7月3日在北京购买了这幅画。在购买前,他详细询问了画的来源,但张 Certain assured him that the painting came directly from the artist, "absolutely reliable and genuine." After receiving the painting, he showed it to a friend who took a photo of it and sent it to History for authentication. The response was that the painting was fake. However, Li's attempts to negotiate with Zhang for a refund were unsuccessful.
In February 2022, Li sought out History himself and asked him to authenticate the painting. History examined the painting carefully and wrote down his opinion: "This is a forgery of my own work 'Gold Autumn'". Li sued Zhang in court, seeking compensation for the purchase price of 70 million yuan plus interest totaling 81.86 million yuan.
Zhang's lawyer argued that Li had willingly purchased the painting from him without any guarantees or promises about its authenticity. He pointed out that as an art dealer, Li should have known there was a risk buying unauthenticated artworks. According to market rules, buyers must inspect goods before paying cash upfront; once paid, sales are final.
During trial, both parties presented evidence - including photos of paintings on History's official website showing high prices for his works - but could not agree on whether this proved anything about authenticity or value.
Artist History testified under oath that he recognized one version of Gold Autumn owned by Wang (another collector), which he described as very crude and clearly fake; in Panjiayuan Market where such things are sold commonly at three hundred up to five hundred yuan now).
